The best guidance can be found in the American Birding Association's Code of Birding Ethics. The code is here: http://www.aba.org/about/ethics.html The advice regarding rare breeding birds is also applicable to vagrant birds. For example, some photographers were seen to venture too close to the recent Say's Phoebe at Sandy Cove (walking right alongside the favoured kelp feeding area, for example), and that tapes of its call were made to attempt to lure it. Eastern Kingbirds also decamped the kelp when the lenses were too close. And if there are other observers watching for a rare (or other) bird, photographers should always ask permission of the other observers before venturing closer to try to obtain photographs. Relax.
