For starters copyright is surely context sensitive. One should =
expect different standards of copyright protection and different =
practices to apply to art, poetry, music, articles in a daily newspaper, =
articles in a Journal, images on a website...=20
And there are plenty of real problems without generating imaginary =
ones.
Provided both the identity of the author of an article and the name =
of the Journal, in which it was published, are displayed I fail to see =
how making that article available on the internet could be construed as =
an infringement of copyright. It is just a convenient form of library. I =
offer that opinion as a practioner of common sense not as a legal =
expert.=20
But can anyone cite one instance when a practice comparable to this =
was officially considered to be copyright infringement and the culprit =
was fined ?
I recall a similar question arising when xerox machines came into =
use. The argument went-- "Making a photocopy of a journal article =
without permission of the publisher is copyright infringement [it says =
so on page 1] and therefore is illegal." or words to that effect. That =
was quickly shot down with the counterargument-- "How would Journals get =
any work done if everybody who wanted to copy a paper requested =
permission to do so ? They would go out of business."=20
That "All rights reserved statement."; "No part of this publication =
may be reproduced...without the prior written permission..." protects =
the publisher from having parts or all of a publication reprinted for =
sale.

(I still think open sharing should be the default, and find it =
ethically perverted that that doesn't seem to be the case. Giving =
credit where credit is due and paying reasonably, particularly when =
commercial gain is likely, are reasonable limitations to impose.)=20

One of these days, we gotta have a long discussion, as a society, on =
how copyright and intellectual property laws can stifle the free flow of =
information, and a lot of other good things.

In an earlier life in the Third World, it would have been =
unconscionable not to share a discovery with colleagues ASAP, with no =
consideration of "What's in it for me?" Otherwise, needful people could =
have been denied timely responses to their issues. So a lot of the talk =
around intellectual property leaves me puzzled, to be excessively =
polite.
