That unobstructed public access to the sand spit known as Sperry's beach be re-established
Option
We recommend that:
- A Committee be mandated to accept an offer from a law firm to engage in a process which will
- by discovery if possible
- by court action if necessary
re-establish unobstructed public access by permanent prescriptive easement

On August 3, 2004, the Committee met with
- Richard Hurlburt- Minister NS Natural Resources
- Brian Gilbert- Acting Deputy-Minister
- Kerry Morash- Minister NS Environment
- Cameron Crowell- Constituency Assistant
- Carolyn Bolivar-Getson- MLA- Lunenburg West
- Tom Bird- Constituency Assistant
and also recommended that, as all three MLA's are Cabinet Ministers and sit on the Executive Council, that they present a common Recommendation to the August 18, 2004 meeting of the Executive Council to create a public easement to Sperry's Beach by Order In Council.This would solve the immediate short-term issue of public access while longer-term solutions for the consolidation of the beach area are developed
Option
We recommend that:
- A Committee be mandated to confirm a banking arrangement with The Friends Of Crescent Beach whereby the Friends will receive and issue receipts for donations, keep those funds in a separate bank account dedicated to the Sperry’s Beach legal process, and account for them
