November 29, 2000 the FOCB Board of Directors wrote to Gordon Adams:
We would appreciate it if you would advise us of the status of this matter at your earliest opportunity.
and again on January 5, 2001:
May I have a reply to my letter of November 29, 2000?
January 11, 2001 Gordon Adams replied:
The Sperry's Beach matter was turned over to the Land Administration Division for action. I was informed yesterday, January 10, that they have taken action earlier this week.
February 19, 2001 the FOCB Board of Directors wrote to Gerry Joudrey, Regional Director NS Natural Resources:
On January 11, 2001 Mr Gordon Adams advised that the Land Administration Division had "taken action" on this matter in that same week.We would appreciate it if you would advise us what specific action was taken and approximately when we can expect a final resolution of this matter.
February 23, 2001 he replied:
This matter has been referred to our Land Administration Branch in Halifax. Therefore I am forwarding your letter to them for a possible response as they are dealing with this file.
March 15, 2001 the FOCB Board of Directors wrote to the Land Administration Division, NS Natural Resources:
Further to our letter to Gerry Joudrey, which he forwarded to you, we would appreciate a reply at your earliest opportunity.
and again on April 9, 2001:
Further to my letter of March 15, 2001 and our letter to Gerry Joudrey, which was previously forwarded to you, we have still not received a reply from you.As you are aware, Gordon Adams of the Bridgewater office of the Dept. of Natrual Resources, referred this matter to you some time ago with the assurance that the matter would be taken care of. It is now April and we are still awaiting a response as to what action had been taken, to date.
The Minutes of the FOCB Board of Directors meeting April 13, 2001 report a phone conversation with "Rosalind Penfound from the Land Administration Division in Halifax, who advised that David Himmelman was given notice to remove the fence by April 1st, 2001, however, he had asked for an extension and now has until June 1st, 2001 to do so. We have not received any written reply to any of our letters in this regard.
This was confirmed in a letter to Ms Penfound dated April 25, 2001:
This is to confirm our telephone conversation of recent date in which you advised that Mr. Himmelman has been given notice to move the fence by June 1, 2001, which is the extension date given to him after his original notice.

unable to contact Rosalind Penfound about the June 1 deadline for the Himmelmans to remove their fence blocking access to Sperry's Beach.
